The Old Jlog

06 December 2005

Been a little while since I posted. Why I thought I could keep up posting regularly, I don't know. I take this opportunity because I'm trapped in the law school right now. I guess trapped is a strong word because it's only a 7-mile walk to my house from here, so I'm at least stifled.

It's 10:38 PM; I've been here since 9:32 AM. Yesterday, I got here at 8:12 AM, and I went home last night at 11:57 PM. Also yesterday, I answered the 60 multiple choice questions from hell -- my Evidence exam. "60 questions?" you ask. 60 questions, 3 hours. Easy, right? That's 3 minutes per question, and surely you'll be able to answer a question in less than 3 minutes. Well, maybe it did take me less than 3 minutes on some of the questions, but I'm not sure because I didn't have time to look at the clock.

Tomorrow - Intellectual Property. I've never wanted to take an essay exam more.

So, backed to me being trapped. I've stopped studying because at this point it's definitely not going to do any good; I've been here 13 hours. I think my new philosophy may be that if you can't learn something in 13 hours, it's not worth learning. 12 hours? No, it's gotta be 13 because there's plenty of things you can't learn in half a day, but 13 hours is just right. Speaking of 13, if you put a zero in the middle, that's 103. 103? Yes, there's a federal Rule of Evidence that begins with that number. It's about rulings on evidence. I'd say more but I expunged my evidence knowledge immediately following the exam yesterday. You think I'm joking?

There also happens to be a section 103 in the patent act that's all about nonobviousness. Yes, when I got to law school I had to add that word to dictionary in Microsoft Word -- I can't stand that red squigly line underneath every other word I type these days.

As if that weren't enough, there's a 103 in the copyright act as well -- dealing with subject matter of copyrightable material, specifically compilations and derivative works.

On Saturday, I will take my professional responsibility exam. There's no 103, but there is a rule 1.3 and 1.13 in the Model Rules of Professional Conduct. 1.3 is about a lawyer's diligence, and 1.13 is something about organization, I think. I'll know by Saturday, hopefully.

Thankfully, though, there is no 103 in the Lanham Act, at least not that I have to know anything about. And there's no 103 in Admin either - just the pure sweetness of 551, 553, 554, 556, 557, 701, and 706.

Speaking of 706, though, there's this good rule about court-appointed experts in Rule 706 of the Federal Rules of Evidence.

So, yeah, I'm trapped. Kim dropped me off this morning -- no car, too late to take a bus, the bus doesn't go by my place anyway, and the law school is dead because the 1Ls crashed from taking their Civil Procedure exam today, and I'm pretty sure I'm the only 2L with a final between now and Friday besides the 11 other poor souls that took IP. Kim will be here to pick me up, I just don't know when since she is also trapped -- held at the mercy of a Duke business school professor who went to a movie with his wife and left his three children with Kim.

Speaking of Duke, I'd like to give a shout out to Texas for knocking off the #1 seed on Saturday. I know it hasn't happened yet, but can anyone else say "overrated" with me. To quote one of my favorite fan posters, "J.J. is Redick-ulous"... and Shelden Williams, come on man, lose the mustache. And by the way, what's up with playing in New Jersey -- everyone jokes that you should be called the University of New Jersey at Durham, but you have to have the "home" advantage? Well, it's not going to work out this Saturday, have fun coming back to Durham bumped from #1.

Don't mess with Texas. Go Tarheels.

By the way, nothing against Duke, I almost went to law school there. It's just that the Duke undergrads are the children of Satan, possessed to cheer for basketball, and hail Coach K as their god. That's all.

Speaking of basketball. How about that UNC-UK game? Now, I'm from Kentucky. In fact, my family lives in Lexington, KY and has for several years. I grew up as a Wildcats fan and maybe that's why I bite my thumb at Duke. But I guess the sentiment has doubled since becoming a Tarheel fan. So, about that game, I had this problem last year as well. Who to cheer for? The team that I grew up with, or the Tarheels? Doubly difficult because I almost went to law school at UK and got a pretty darn good scholarship.

Last year, I attended the UNC-UK matchup at the Dean Dome. I was decked out in my Kentucky t-shirt and my Carolina hat. I couldn't just erase my heritage so easily, especially not amongst thousands of screaming Tarheel fans who wanted to see my Cats lose. But wait, my Cats? They're not really my Cats. I had never been to a Wildcats game before seeing them play Carolina, and I was rooting for them?

As it turns out, my solution is pretty simple. Cheer for who's winning. That's made me a huge Tarheel fan during the last two times they've played. Until they meet in the playoffs, I'm good with that decision.

I know that all of the zero people who are reading this would like me to keep going, but I've finally gotten the call. I must go home.
